According to the filing, Musk disclosed under sworn interrogation that he had discussed potential financing or investment arrangements with Zuckerberg in connection to his consortium’s offer for OpenAI. The company, which runs ChatGPT, highlighted these communications as it pressed a federal judge to compel Meta to hand over documents related to any bids for OpenAI, as well as records concerning potential restructuring or recapitalization.
“Meta’s communications with other bidders, or internal communications, including those reflecting discussions with Musk or other bidders, would also shed light on the motivations for the bid,” OpenAI argued, describing both Musk and Meta as among its most significant rivals in the AI industry.
Meta, however, pushed back, urging the court to deny OpenAI’s request. In its own filing, the company argued that such communications were not relevant to the case. “Meta’s own communications concerning OpenAI’s restructuring or recapitalization (even as narrowed) are not relevant to this action,” it stated, adding that OpenAI should seek any necessary records directly from Musk or his AI startup, xAI.
The revelations add another layer to the intensifying legal feud between Musk and OpenAI. The Tesla and SpaceX chief sued OpenAI and its CEO, Sam Altman, last year, claiming the company strayed from its original nonprofit mission when it adopted a for-profit model. OpenAI responded with a countersuit in April, accusing Musk of attempting to damage the company through press statements, social media posts, legal challenges, and what it called a “sham bid” for its assets.
Earlier this month, U.S. District Judge Yvonne Gonzalez Rogers ruled that Musk must face OpenAI’s counterclaims. The case is now moving toward a jury trial scheduled for spring 2026, setting the stage for one of the most high-profile courtroom battles in the AI sector.
Musk, whose xAI venture is positioning itself as a competitor to both OpenAI and Meta in the generative AI market, has yet to comment on the latest filing. Requests for comment sent to xAI outside regular business hours went unanswered.
